Agreement and eligibility
These terms form an agreement between you and the PixMender service operator. By creating an account, accessing the API or using the service, you accept these terms and the Acceptable Use Policy. You must be at least 18, or the age of legal majority where you live, and have authority to bind any organization you represent.
Accounts and credentials
Provide accurate account information and keep your password, session and API keys confidential. You are responsible for activity performed through your credentials until you notify us of unauthorized access. API keys must be used only by you or systems acting on your behalf and should be scoped and revoked when no longer needed.
Your content and instructions
You retain your rights in images, prompts and other material you submit. You grant PixMender and its processing providers a limited, non-exclusive right to host, copy, transform and transmit that material only as needed to provide, secure and support the service. You confirm that you have all rights, notices and consents required to submit and modify it.
AI-generated results
Image operations are automated and can produce inaccurate, incomplete or unexpected results. Review every result before publication or use in a decision, regulated workflow or high-risk context. PixMender does not promise that a result will preserve factual detail, satisfy a particular professional standard or be free of third-party claims.
Credits and successful operations
A standard completed image action consumes 1 credit. Upscale consumes 0.5 credit. Optimization consumes 0.1 credit alone and is free with another operation. Credits reserved for a job are settled on success and released after a terminal processing failure. Current pack sizes, grants and prices are shown on the Pricing page and at checkout.
Payments, blockchain transfers and refunds
Credit purchases are prepaid and currently use USDT on the displayed TRON network and contract. You are responsible for using the exact address, token, network and amount shown at checkout and for any wallet or network fee. Blockchain transfers are generally irreversible. If a correctly matched purchase is not credited, or law requires a refund, contact support with the order and transaction identifiers; refunds are reviewed individually and may require identity, ownership and destination checks.
Free grants and promotions
Signup, daily or gift credits are promotional, non-transferable and have no cash value. We may correct duplicate or erroneous grants and may limit promotions where accounts are created or used to evade eligibility, rate or abuse controls.
API and webhooks
Follow the published API contract, rate limits and security requirements. Use idempotency keys where supported, validate signed webhook events and design integrations for retries, duplicate deliveries and asynchronous completion. You may not resell access to shared credentials or bypass usage measurement and safety controls.
Acceptable use
Do not use PixMender for unlawful, fraudulent, deceptive, abusive or rights-infringing activity; to create harmful impersonation; to process intimate imagery without consent; to attack systems; or to remove attribution in order to misrepresent ownership or evade a license. The Acceptable Use Policy provides more detail and is incorporated into these terms.
PixMender materials
The service, website, software, documentation, branding and underlying technology are owned by PixMender or its licensors. These terms give you a limited, revocable, non-transferable right to use them while complying with the agreement. Feedback may be used without restriction or payment, but it does not transfer ownership of your submitted content.
Availability and changes
We aim to operate a reliable service but do not guarantee uninterrupted availability, a particular provider or permanent support for every operation, model or format. We may change limits and features for security, legal, provider or operational reasons. Material pricing or contractual changes will be posted or communicated before they apply when reasonably possible.
Suspension and termination
We may limit or suspend access to protect the service, comply with law, investigate suspected abuse, address non-payment or prevent harm. You may stop using the service at any time and can request account closure through support. Provisions concerning rights, payments, disclaimers, liability, disputes and records survive where their nature requires it.
Disclaimers
To the fullest extent permitted by law, PixMender is provided as available without implied warranties of merchantability, fitness for a particular purpose, non-infringement or uninterrupted operation. Nothing in these terms excludes a warranty, remedy or consumer right that applicable law does not permit us to exclude.
Liability
To the fullest extent permitted by law, PixMender is not liable for indirect, incidental, special, consequential or lost-profit damages, or for loss caused by your credentials, unlawful source content, blockchain transfer error or use of an unreviewed result. PixMender's aggregate liability arising from the service will not exceed the amount you paid for the service during the three months before the event giving rise to the claim. These limits do not apply where prohibited by law.
Governing law and contact
These terms are governed by the laws of Cyprus, without regard to conflict-of-law rules, while mandatory consumer protections and forums available in your country remain unaffected.
